To avoid any negative consequences, students are strongly advised to make sure that they adequately acknowledge print and electronic resources in their assignment before uploading it on Turnitin Assignment.  Any assignment containing plagiarism will be penalized and disciplinary proceedings will be taken against students who plagiarize.  Plagiarism includes: (i) paraphrasing of another person’s words or the use of another person’s ideas without proper referencing in footnotes; and (ii) quoting of another person’s words without placing the quote within quotation marks and without proper referencing in footnotes.  You may discuss your work with others but are required to provide your own answers.

Assessment Criteria: The assignment will be assessed in accordance with the following criteria:

1. The extent of research demonstrated and the overall grasp of the subject matter

Extent to which resources located are beyond the common-place (e.g., includes references to overseas sources, works from other related disciplines, early or ancient sources on which the contemporary law is based)
The number, type and relevance of sources used (e.g., avoidance of frequent reference to one source, importance or weight of sources cited)
Accurate and comprehensive understanding of the law (e.g., correct identification of key cases or articles)

2. The depth of analysis and evaluation

Clarity in structure of arguments
Emphasis on critical analysis (as opposed to descriptive or discursive narrative)
Quality and persuasiveness of the argument (i.e., opinions supported by convincing arguments and sources, issues followed through, arguments carefully considered and fully developed, implications explored, contrary arguments anticipated)
Synthesis and criticism of the authorities, sources and commentaries
Selection and use of sources in support of student’s own argument/analysis
Evidence that the student has critically assessed and qualified his or her own arguments

3. The level of originality demonstrated
New insight or perspective on the subject
Presence of an ‘author’s voice’ (does the author make clear his or her own views in relation to issues discussed?)
Compelling solutions, alternatives or proposals offered (if necessary)

4. The quality of the legal writing
Effective use of headings and sub-headings
Logical and coherent structure
Clear transitions between sections of the paper (an introduction and a conclusion should be included)
Clarity and conciseness in writing style and argument
Correct grammar, spelling and punctuation
Appropriate use of footnotes
Accurate citation and compliance with style guide
General care and consideration in quality of overall product
